1 Agreement

These Terms of Service ("Terms") govern your use of the BabyShield mobile application and website (the "Services") provided by Cureviax Research LLC ("Cureviax," "we," "our," "us").

By using BabyShield, you agree to these Terms

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2 Eligibility

Age Requirement

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Services.

Organization Use

If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.

3 Accounts & Sign-In

Privacy-First Authentication
  • Identity providers: Sign in with Apple and Google Sign-In
  • We store: Internal user ID and provider's subject identifier ("sub")
  • We do NOT store: Your email address from Apple or Google

Security Responsibility

You are responsible for maintaining the security of your device and sign-in credentials with Apple/Google.

Account Deletion

You may delete your account at any time (see Section 13 and the Data Deletion page).

4 Description of the Services

BabyShield aggregates and displays recall/safety information from official sources such as the U.S. Food and Drug Administration (FDA), U.S. Consumer Product Safety Commission (CPSC), and the EU Safety Gate (RAPEX).

Data Limitations

We do not guarantee that any particular product or barcode is present in our data, and we do not guarantee completeness or timeliness of third-party data.

The Services provide informational safety and recall data only. The Services are not medical advice or a substitute for professional judgment, and not a medical device. Always consult qualified professionals for medical or safety decisions.

6 License & Intellectual Property

Your License to Use BabyShield

Subject to these Terms, Cureviax grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes.

All rights, title, and interest in the Services (including software, designs, and content we create) remain with Cureviax and its licensors.

Logos and names of third-party agencies (e.g., FDA, CPSC, European Commission) are trademarks of their respective owners. Cureviax is not affiliated with, endorsed by, or sponsored by those agencies.

7 Device Permissions

Camera Permission

Used solely for barcode scanning. Camera frames are processed on-device; only the recognized barcode number may be sent to our API.
Permission Control

You can disable permissions in your device settings, but some features may not function.

8 Acceptable Use

You agree not to:
  • Use the Services for unlawful, harmful, misleading, or fraudulent purposes
  • Interfere with or disrupt the Services, including by overloading, scraping without permission, or bypassing rate limits
  • Reverse engineer, decompile, or attempt to extract source code except to the extent permitted by law
  • Use any automated system to access the Services in a manner that sends more request messages than a human could reasonably produce

We may modify, suspend, or discontinue all or part of the Services at any time with or without notice.

11 Fees

Currently Free

The Services are currently provided free of charge. If we introduce paid features in the future, we will provide clear notice and updated terms before any charges apply.

13 Termination

Your Right to Leave

You may stop using the Services at any time and delete your account in-app (Settings → Privacy → Delete my account) or as described on the Data Deletion page.

Upon termination, your license ends and certain data may be retained as described in the Privacy Policy and applicable law.

14 Disclaimers

Service Provided "AS IS"

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUREVIAX AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED.

15 Limitation of Liability

Liability Limits

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL CUREVIAX, ITS AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

16 Indemnification

Your Responsibilities

You agree to indemnify and hold harmless Cureviax and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or misuse of the Services.

17 Governing Law & Dispute Resolution

For users in the United States

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Arbitration

Except for small-claims matters, any dispute will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Class-Action Waiver & Opt-Out

You and Cureviax waive any right to a jury trial and to participate in a class action. You may opt out of arbitration within 30 days of accepting these Terms by emailing support@babyshield.cureviax.com with subject "Arbitration Opt-Out."

For users outside the United States

Consumer Protections

Where local law requires, you may have the right to bring claims in your home country courts. Mandatory consumer protections in your country of residence remain unaffected by these Terms.

18 Changes to the Terms

Term Updates

We may update these Terms from time to time. Material changes will be notified in-app or by other reasonable means at least 30 days before they take effect. Continued use after changes take effect constitutes acceptance of the updated Terms.

19 Miscellaneous

Severability

If any provision is held invalid, the remaining provisions remain in full force and effect.

No Waiver

Our failure to enforce a provision is not a waiver of the right to do so later.

Assignment

You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, or asset sale.

Entire Agreement

These Terms and the Privacy Policy are the entire agreement between you and Cureviax regarding the Services.
